Case No.83 of 2012 for the offence under Sections 413 and 414 of the Indian Penal Code and Section 7 of the Essential Commodities Act. He is in custody since 26.07.2017.
Primarily the offence is under Section 7 of the Essential Commodities Act and only on account of seizure of 120 tina Dalada of Bangi Company and 49 Boxes of Khajur Marka Dalda from the house of the petitioner, he has been implicated on the suspicion that it is being kept in the house for black marketing.
Considering the fact that the applicant has been in custody since 26.07.2017 and the offence is under Section 7 of the E C Act and there is no allegation of adulteration or irregularity in the material seized, this application is allowed. Let the petitioner
Patna High Court Cr.Misc. No.47085 of 2017(2) dt.22-09-2017 2/2 be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Viashali at Hajipur in connection with Bhagwanpur P. S. Case No.83 of 2012.
