The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under section 323, 498A/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant but the complainant eloped with the petitioner's cousin, namely, Vikas for which the petitioner lodged a Sanha on 17.1.2010 before the Vasant Kunj Police Station, New Delhi and the same has been

Patna High Court Cr.Misc. No.32102 of 2016 (2) dt.01-08-2016 brought as Annexure 3 to this petition. Thereafter the present complaint was filed on 10.5.2013.

Considering the nature of accusation and lodging of Sanha at the earlier point of time, let the abovenamed petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Madhubani in C.R. No. 546/2013 (Tr.No. 4569/2014), subject to the conditions as laid down under section 438(2) of the Cr.P.C.
