JUSTICE RAVI RANJAN ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The petitioners apprehends his arrest in connection with a case registered for the offences punishable under Sections 420, 406 and 504 of the Indian Penal Code.

It is submitted on behalf of the petitioner that as per allegation, about Rs.7,54,235/- has been allegedly not paid by the petitioner. Subsequently, a compromise petition has been filed before the court below, a copy of which has been appended as Annexure-2 to the supplementary affidavit filed by the petitioner disclosing that Rs.3,80,735/- has already been paid to the informant and the rest amount of Rs.3,83,500/- would be paid on or before 30.02.2017.

Accordingly, let the above named petitioner be

Patna High Court Cr.Misc. No.32186 of 2016 (3) dt.05-09-2016 2/2 released on provisional bail for six months in the event of arrest/surrender before the court below within a period of six weeks from today in Aurangabad (M) P.S. Case No.105 of 2016 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure with further condition that the rest amount of Rs.3,83,500/- would be deposited by the petitioner by way of Bank Draft in the name of the informant in installment in the court below. The informant would be at liberty to withdraw the same. If the rest amount of Rs.3,83,500/- would be deposited by the petitioner by 30.02.2017, the court below would make the provisional bail absolute.

However, such payment would be subject to the final result of the criminal case concerned and also would be without prejudice to the stand which would be taken for his defence in the case concerned.
