====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-02-2021 Heard Mr. Rana Bhupendra Narayan Singh, learned counsel for the petitioner and Mr. Chandra Sen Prasad, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Harlakhi P.S. Case No. 244 of 2019 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code 1860.

The allegation as per the First Information Report is that the petitioner abducted the daughter of the informant for the purpose of marriage.

Learned counsel for the petitioner submits that the

No.40206 of 2020(2) dt.22-02-2021 2/3 petitioner has falsely been implicated in this case inasmuch as there was love affair between the petitioner and the victim girl and the petitioner has performed marriage with the victim girl in a temple which would be evident from the statement of the victim girl recorded under Section 164 Cr. P.C. (Annexure-2). Learned counsel further submits that the victim girl has disclosed her age as 16 years at the time of recording her statement under Section 164 Cr. P.C. Learned counsel also submits that the petitioner is in custody since 15.05.2020 and he has got no criminal antecedent. Having regard to the submissions made by the parties and taking into consideration the materials on record and the statement of the victim girl recorded under Section 164 Cr. P.C., I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Benipatti, Distt. Madhubani, in connection with Harlakhi P.S. Case No. 244 of 2019.
