====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Santosh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 24.07.2017 in Runnisaidpur P.S. Case No.349/2017 registered for the offence under Sections 272,273 of the Indian Penal Code and Sections 30,30(g), 38(1)(2) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on allegation of recovery of huge quantity of country made liquor from the paddy filed, the petitioner has been made accused. It was submitted that the petitioner was not at all aware regarding the said recovery. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean

Considering the nature of accusation, period of custody as well as clean antecedent, let the petitioner, namely, Madan Ram be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned I/C A.D.J.II-cum- Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P.S. Case No.349/2017.
