2. The petitioner has prayed for bail registered for the offence punishable under Sections 103(1), 61(2) and 3(5) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that the petitioner, along with others, arrived at the place of occurrence armed with sharp-cutting weapons and surrounded the husband of the informant. It is alleged that Santosh Paswan gave a dabia blow on the parietal region of the victim's head, Ramji Paswan gave two blows on the victim's face, and Nageshwar Paswan inflicted a cut injury on the victim's neck, as a result of which he died on the spot.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.42925 of 2026(2) dt.01-07-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He further submits that, from perusal of the FIR, it will transpire that though the petitioner has been arrayed as an accused, no specific overt role has been attributed to him. It is further submitted that no weapon has been attributed to the petitioner. The main thrust of allegations are against Santosh Paswan, Ramji Paswan and Nageshwar Paswan, while the allegations against the remaining accused persons, including the petitioner, are general and omnibus in nature. Learned counsel further submits that, during the course of investigation, it has come that the petitioner's alleged role the petitioner was there only in the conspiracy. It is submitted that the petitioner neither assaulted the deceased nor given any injury assault or blow to the deceased. Moreover, the petitioner is languishing in judicial custody since 19.11.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner has got criminal antecedent of four cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the conditions

No.42925 of 2026(2) dt.01-07-2026 3/3 that the petitioner shall cooperate in trial, shall remain physically present on each and every date fixed by the learned court below and one of the bailors shall be his near relative. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Supaul in connection with Birpur P.S. Case No. 381 of 2025.
