Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek bail in connection with Warsaliganj P. S. Case No. 96 of 2016 registered under Section 302 read with 34 and 201 of the Indian Penal Code. The prayer for bail of the petitioners was rejected earlier twice by this Court.
It is stated that the petitioners are in custody since 25.05.2016 and after commitment, the trial of the case has
Patna High Court Cr.Misc. No.50737 of 2017 (2) dt.08-11-2017 2/2 already commenced in which P. W. 1 Arti Kumari has turned hostile.
Be that as it may, regard being had to the reasons assigned in my previous order dated 08.02.2017 passed in Cr. Misc. No. 2955 of 2017, I see no reason to take a different view of the mater. Accordingly, the application for grant of bail is rejected.
However, since the petitioners are in custody, learned 2nd Additional Sessions Judge, Nawadah before whom Warsaliganj P. S. Case No. 96 of 2016 corresponding to Session Trial No. 76 of 2017 is pending, is directed to expedite the trial and conclude the same as early as possible.
