No one appears for the State.
The petitioner is seeking regular bail in Alamnagar P.S. Case No. 39 of 2017 for the offences alleged under Sections 147, 149, 341, 323, 324, 325, 307, 354, 379, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the only allegation against this petitioner is that he pulled down the wife of the informant catching hold her by her hair and assaulted her by Lathi and Danda. Learned counsel further submits that there is a counter case also which has been registered as Alamnagar P.S. Case No. 40 of 2017. No doubt, there are some injury reports on
Patna High Court Cr.Misc. No.36220 of 2017 (2) dt.10-08-2017 2/2 the record, which have also been noticed by the learned Sessions Judge, but so far as the wife of the informant is concerned, no injury has been found on her body.
Learned counsel for the informant opposed the prayer for bail. However, he could not controvert this submission that the wife of the informant has got any injury and there is no injury report with respect to the wife of the informant. In the facts and circumstances stated above, let the petitioner, namely, Chaturi Mandal @ Chaturi Sharma, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Udakishunganj, District Madhepura in connection with Alamnagar P.S. Case No. 39 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
