Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Hajipur Sadar P.S. Case No. 523 of 2017 registered for the offence punishable under Sections 363, 366(A), 372. 120(B) of the Indian Penal Code. Allegation against petitioner is of kidnapping the daughter of the informant.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this

Patna High Court Cr.Misc. No.54191 of 2018(4) dt.10-10-2018 2/2 case. Statement recorded under Section 164 of Cr.P.C. in which she has stated that there is land dispute between the parties. It has been further submitted that co-accused, namely, Shashi Chandra Bose @ Mukul and Rakesh Kumar have been granted bail by this Hon'ble Court as contained in Annexure-2 and 2/A. Petitioner is in custody since 05.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 523 of 2017. (S. Kumar, J) veena/- U T
