Learned counsel for the petitioner submits that on 25.08.2017 when he was ready to argue the case, he received a telephonic message that his wife fell seriously ill due to which he could not attend the case, and as such, without informing the Court he left the Court. Thus, the case was dismissed. In view of the aforesaid facts and circumstances, the restoration application is allowed and Cri. Misc. No.40523 of 2017 is restored to its original file.
