Mr. Nand Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 08-07-2026 Heard the learned Advocate for the petitioners and the learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in connection with Thakurganj P.S. Case No. 59 of 2026, registered for the offences punishable under Sections 189(2), 126(2), 115(2), 118(1), 117(2), 109(1), 303(2), 352 and 351(2) of the BNS, 2023.
3. On the given date and time of occurrence, while the petitioners were indulged in putting tali over the land of the informant and when the same was objected, the petitioners
Patna High Court CR. MISC. No.44010 of 2026(2) dt.08-07-2026 2/3 along with others brutally assaulted the informant and his brother. It is specifically alleged that co-accused Sakir and Keyum assaulted the informant by means of knife upon his stomach and head, whereas co-accused Saddam has broken the hand of the informant.

Learned Advocate for the petitioners taking this Court through the FIR contended that the specific accusation has been levelled against co-accused Keyum, Sakir and Saddam, who are not before this Court. So far the petitioners are concerned, they are said to be a member of the mob, but without any specific accusation. Moreover, from the FIR it appears that the genesis of the occurrence is nothing but a land dispute. There is a counter version of the present case being Thakurganj P.S. Case No. 60 of 2026, for the offences under Section 109(1) and other allied Sections of the BNS. The persons of the petitioners side have also sustained injury. So far the petitioners are concerned, they are persons of fair antecedent and they undertake that they will fully co-operate in the proceeding of the Court.
5. On the other hand, learned Advocate for the State opposed the pre-arrest bail application and submits that all the accused persons, including the petitioners, have assaulted the
Patna High Court CR. MISC. No.44010 of 2026(2) dt.08-07-2026 3/3 informant and his brother, due to which the informant has sustained grievous injuries over his head.

Regard being had to the submissions made on behalf of the parties and considering the nature of accusation levelled against the petitioners, who have not been allegedly found causing any overt act, coupled with their fair antecedent and the factum of case and counter case, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Thakurganj P.S. Case No. 59 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioners.
