2. The petitioner has preferred this application for grant of regular bail in connection with Ramgarh Chowk P.S. Case No. 83 of 2026 dated 15.04.2026 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act.
3. As per the allegation, 1379.34 litres of illicit foreign liquor was recovered from the house of one Ashok Yadav.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.45353 of 2026(2) dt.08-07-2026 2/3 case. It has further been submitted that petitioner was labourer and was doing the job on daily remuneration. It has further been submitted that the house belongs to co-accused Ashok Yadav and not this petitioner. It has further been submitted that the procedure prescribed under Section 103 BNSS has not been followed with. It has further been submitted that co-accused persons Raja Paswan and Chhotu Kumar @ Vivek Kumar have been extended the privilege of bail by a Co-ordinate Bench of this Court by order dated 17.06.2026 passed in Cr. Misc. No. 39216 of 2026. It has further been submitted that although the petitioner has been made accused in two other cases of similar nature but he is on bail in both cases. It has lastly been submitted that petitioner is in custody since 16.04.2026
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.
6. Heard learned counsel for the parties and perused the records.
7. Considering the facts and circumstances of the case as well as the parity, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai
