====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-01-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Kharagpur P.S. Case No.73 of 2016 registered under Section 395 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the Haiwa Driver, the present case was lodged against 15-20 unknown and the informant has not claimed to identify the culprits. In course of investigation, one Satendra Singh was apprehended by the police, who confessed his guilt and also disclosed the name of the petitioner. Later on, it has come in paragraph-7 of the case diary, in the statement of
Patna High Court Cr.Misc. No.54895 of 2018(3) dt.31-01-2019 2/2 the witness, that in course of talking, the miscreants were using the name of the petitioner and when the house of the petitioner was raided, the petitioner was not found present there. The petitioner has no criminal antecedents.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Munger, in connection with Kharagpur P.S. Case No.73 of 2016/G.R. No.833 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
