====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 12-03-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner has filed the instant application for grant of regular bail in connection with Excise Case no. 255 of 2020 registered under section 30(a) of Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., 242.28 litre of illicit liquor is stated to have been recovered from the vehicle being driven by this petitioner and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that no recovery of any incriminating article as alleged has taken place. He is in custody since 24.09.2020 and has no criminal antecedent.

A report with respect to the antecedent of the petitioner was called for and the same has been received. Having heard learned counsel for the parties and taking into consideration the period of custody and the petitioner having no criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Excise Case no. 255 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd cum Special Judge, Excise Act, Gopalganj.
