JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Barh P.S. Case No. 519 of 2015 for the offences instituted under Sections 420, 467, 468, 471 and 386/34 of the IPC. The prosecution story, in brief, is that the accused persons by making conspiracy sold the valuable land of the complainant situated at Bakhtiarpur Maua by creating forged and fabricated documents and by torturing the father-in-law and husband of the complainant. It is further alleged in the complaint petition that the accused Ravi Shankar Singh and other co-accused persons have prepared a forged Mokhtarnama in the name of the father-in-law of the complainant and on the basis of said

Patna High Court Cr.Misc. No.27446 of 2016 (2) dt.12-07-2016 2/2 Mokhtarnama he sold several land of the complainant and due to this the complainant has suffered monetary loss of Rs. 12,79,000/-. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been implicated in the present case. The matter relates to sale and purchase of land. Prior to institution of the present case, a title suit was filed by the complainant vide Annexure-2 to the present application. The other co-accused has already been granted anticipatory bail vide A.B.P. No. 1119 of 2016 by the court below. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Barh P.S. Case No. 519/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
