The petitioner apprehends his arrest in connection with Sessions Trial No. 168 of 2015 arising out of Vidyapati Nagar P.S. Case No. 133 of 2014 registered under Section 302/34 of the I.P.C. pending in the Court of 1st Additional Sessions Judge, Samastipur Submission is that earlier prayer of the petitioner for bail was rejected on merit by this Court on 08.09.2017 passed in Cr. Mic. No. 30871 of 2017 with direction to the Trial Court to expedite the trial, but up-till-now the trial has not been concluded.
On perusal of the report of the Additional District and
Patna High Court Cr.Misc. No.53208 of 2018(3) dt.10-10-2018 2/2 Sessions Judge-I, Samastipur, it appears that the expected time to conclude the trial is four months.
Having considered the above facts and circumstances of the case, I am not inclined to allow this application. Accordingly, prayer of the petitioner is rejected. However, Trial Court is directed to conclude the trial within a period of three months. If the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail.
