JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. The petitioner seeks bail in connection with Sherghati P.S. Case No.175 of 2020 registered for the offence punishable under Sections 341, 323, 504, 506, 366, 376/34 of the Indian Penal Code.
The prosecution case in short is that, the petitioner was having love affair with the informant and used to talk on mobile phone and he took away the informant with him to Delhi. They lived in a rented house and after the outbreak of pandemic, he took her along with him and left in Dhobi in the way. Then the informant by herself came to his house but his family members kicked her out and the petitioner is not ready to marry the informant.

No.1494 of 2021(3) dt.08-04-2021 2/2 It is submitted by learned counsel for the petitioner that petitioner is quite innocent, has been falsely implicated in this case and has not committed any offence as alleged in the FIR. The informant has already married to another boy. In this regard a certificate has been issued by the Sub-Head of the Village Panchayat of Bajaura, Dhobhi, Gaya disclosing that one Rajesh Yadav has solemnized marriage with Suman Kumar (informant) on 03.09.2020. The petitioner has no criminal antecedent as mentioned in para-3 of the petition and has been languishing in custody since 05.06.2020.
Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, after framing of the charge on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below, where the case is pending, in connection with Sherghati P.S. Case No.175 of 2020.
