Mr.Anant Kumar 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 15-10-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.
2. The accused/petitioner seeks bail in connection with Teghra P.S. Case No. 20 of 2024 registered for the offences under Sections 341, 324, 326, 302, 34 of the I.P.C. and section 27 of the Arms Act.
3. The accused/petitioner is not named in the First Information Report and is in custody since 04.02.2025.
4. As per FIR, the allegation against petitioner is to commit murder of husband of the informant along with other co-accused person by using fire-arm. It is also alleged that the petitioner alongwith other accused persons assaulted the husband of the informant by using sharp edged weapon,
2/4 consequent upon the husband of the informant was died on the spot.

It is submitted by learned counsel appearing on behalf of the petitioner that upon perusal of FIR, it can be gathered safely that the informant projected herself as an eye witness of the occurrence, whereas she is not so, for the reasons that she raised her suspicion regarding involvement of the petitioner with crime in question alongwith co-accused persons.

It is further submitted that son-in-law of informant while coming to his in-laws home found this petitioner alongwith one co-accused namely, Anmol Kumar who was equipped with Axe in same area where the deceased was said to visited in connection with some agriculture work and merely on the said suspicion, the accused persons including this petitioner was implicated with the present case. It is submitted that said Anmol Kumar was already granted bail by one of the learned coordinate Bench of this Court through Cr. Misc. No. 4838 of 2025 dated 08.09.2025.
7. While concluding argument, it is submitted that
3/4 investigation of this case is already completed, charge-sheet has been submitted and as such, there is no chance of tampering with the evidence. Petitioner claims to be a man of clean antecedent.
8. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
9. In view of aforesaid factual submission and by taking note of the fact as prima facie except suspicion arising out of previous enmity and confessional statement of petitioner, nothing incriminating appears during investigation as to connect him prima facie with the present occurrence of murder, coupled with the fact that investigation of this case is already completed, where petitioner is a man of clean antecedent and is in custody since 04.02.2025, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Begusarai/concerned court, in connection with Teghra P.S. Case No. 20 of 2024, subject to the condition as laid down
