JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-06-2019 The grievance of the petitioners in the present case is non-payment of salary and non-fixation of pay scale. Petitioners have been appointed as trained block teachers in middle school Madishlapur & middle school Rakouli under Andar Block in the district of Siwan vide memo no. 522III dated 28.12.2010.

The petitioners have joined the school on 28.12.2010. They have been paid salary till June, 2015 and thereafter they have been denied salary.

Patna High Court CWJC No.12516 of 2019(2) dt.25-06-2019 2/2 Learned counsel for the petitioners would submit that petitioners are still working but respondents have without any rhyme and reason stopped payment of salary.

Considering the aforesaid, the writ petition is disposed of with direction to the District Programme Officer (Establishment), Siwan to examine the claim of the petitioners and if it is found that petitioners are still working as Block Teachers their arrears and current salary shall be paid to the petitioners within a period of sixty days from the date of receipt/production of a copy of this order.

If the payments are not paid to the petitioners, the arrears will carry interest at the rate of 9 per cent per annum and the same shall be realized from the pocket of the District Programme Officer (Establishment), Siwan.

With the aforesaid, the writ petition stands disposed of.
