For the Petitioner/s : Mr. Rama Nand Poddar For the Opposite Party/s : Mr. Yogendra Kumar(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-12-2015 Heard both sides.
The petitioner apprehends arrest in a case registered for the offences punishable under sections 420 and 323 of the Indian Penal Code.
Prayer for anticipatory bail of the petitioner was earlier rejected by order dated 18.02.2015 passed in Criminal Misc. No. 6321 of 2015 but again the petitioner has filed a fresh petition for grant of anticipatory bail on the ground that the marriage was settled in the month of November and the money was deposited in the account of Sanjeet Kumar Singh in the month of January- February 2011 which would appear from the statement
Patna High Court Cr.Misc. No.50518 of 2015 (2) dt.16-12-2015 contained in annexure-3. It is submitted that on wrong facts, anticipatory bail of the petitioner was earlier rejected. It appears that the negotiation was going on and the relative of the bride side deposited rupees two lacs from the month of January till 19.05.2011. The negotiation was broken only because further demand of dowry was not fulfilled. Petitioner is the bride groom. Considering the facts aforesaid, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly this application is rejected in connection with Complaint Case No. 600 ( c) of 2012/Trial No. 4589 of 2012 pending in the court of the learned Chief Judicial Magistrate, Bhojpur at Arrah.
