JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 22.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Naokothi P.S. Case no. 117 of 2020, registered under Section 353 and 506/34 of the Indian Penal Code and Section 25(1AA), 26 and 35 of the Arms Act.

The accusation is that in course of patrolling duty information was received to the effect that near Maheshwara dam, Kamlesh Singh, son of Loha Singh, Ram Shankar Singh

No.38921 of 2020(2) dt.12-07-2021 2/3 (Petitioner), son of Sato Singh and Raja along with 2-3 unknown are indulged in giving threatening to Junior Engineer of electricity, who is present there for removing the fault of electric supply. Thereafter, informant along with other Police personnel reached there and started inquiry. In that course, Kamlesh Singh, Ram Shankar Singh (Petitioner) and Raja Singh came near the dam. On seeing the Police party, due to fear of arrest, Kamlesh Singh fled away throwing the rifle and his associates also fled away from there. Thereafter, thrown rifle along with two motorcycles i.e. black colour pulsar motorcycle and black colour Apache motorcycle without registration number were seized.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has falsely been implicated in this case at the instance of local Chowkidar due to dirty village politics.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
