ANJANA MISHRA ORAL ORDER 27-03-2019 On repeated occasions, this Court has granted liberty to this petitioner to make amends for his past actions. He has not only been harassing the opposite party through various means and the matter has been dealt with in Chambers on several occasions. On the last occasion when the Court took a serious note of the issue and was inclined to dismiss the application, a fresh statement was made in Court that he was willing to keep his wife and make all endeavours to provide for the assistance of his wife as well as the minor daughter. Consequently, the Court, hopeful of some reconciliation between the parties called for the opposite party No. 2 once again to appear in Chambers.
The petitioner Ram Gulam Bhandari as well as the
Patna High Court CR. MISC. No.38965 of 2011(18) dt.27-03-2019 2/3 opposite party Kiran Devi are present in Chambers today. On query made by this Court as to whether the opposite party Kiran Devi is willing to live with the petitioner, she has expressed her anguish and stated that though she is willing to reconcile issues yet the petitioner has been torturing her and also assaulting her physically every time she goes back to him. That apart, the petitioner also inflicted mental torture on her by stating that she is in illicit relation with one Rabindra Singh, who according to the opposite party No. 2 Kiran Devi, is totally unknown to her. In reply to the said assertion by the opposite party No.
2, the petitioner who is present in person has vociferously stated before this Court that even yesterday the petitioner had received a phone call from the said Rabindra Singh who has stated that if he goes to Court tomorrow and tries to bring back his wife, he will face dire consequences as the opposite party will live with him and he is required to provide for her maintenance. On query being made by the Court regarding the phone number from which he had received such a threat, he retracts from his statement and submits that earlier the said Rabindra Singh had come to his place to issue such threats. He is also unable to provide the phone number of the said Rabindra Singh.
Patna High Court CR. MISC. No.38965 of 2011(18) dt.27-03-2019 3/3 informed the local police regarding such threats upon which he submits that the officer of the P.S. Lakhnaur, District Madhubani had been duly informed but they have refused to register a FIR in the matter. It has further been stated by him that under such circumstances, the petitioner is helpless.
This Court is of the full belief that the allegations as made out by him against the said unknown have no legs to stand on and are purely frivolous and fit to be deprecated. So far as the invoking the inherent powers of this Court for setting aside the order impugned in the present application, no sufficient cause has been made out by the petitioner and in view of the series of false affidavits filed by the petitioner, I am not inclined to entertain this application for the reasons indicated in the foregoing paragraphs as well as the earlier orders.
The application stands dismissed.
