The petitioner apprehends his arrest in connection with Dawath P.S. Case No.79 of 2021 registered under Sections 379 and 411 of the Indian Penal Code and Sections 4/40 (7) of Bihar Minor Mineral & Concession Act, 1972 and Section 15 of the Environment Protection Act, 1986.
Learned counsel for the petitioner submits that the petitioner is the owner of the tractor in question. The said tractor was taken by his driver to his native village for his personal work and he purchased sand bona fide from the store but he was not aware of any prohibitory order while carrying the sand as is
Patna High Court CR. MISC. No.52923 of 2021(3) dt.12-01-2023 2/2 evident from Annexure 2 to this application. The petitioner has got no criminal antecedent.
Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M. III, Bikramganj (Rohtas) in connection with Dawath P.S. Case No.79 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Harish/- (Arvind Srivastava, J) U T
