JUSTICE RAMESH KUMAR DATTA) 18-01-2016 Learned counsel for the petitioner submits that due to non-appearance on the date concerned, the peremptory order of this Court dated 03.12.2014 could not be complied with as a result of which the memo of appeal stood rejected on 17.12.2014. On a consideration of the facts and circumstances of the case, Miscellaneous Appeal No.30 of 2013 is restored to its original file subject to the petitioner complying with the order dated 03.12.2014 within a period of one week from today, if not already complied with.

The restoration application is, accordingly, allowed subject to the aforesaid condition.
