Petitioner seeks bail in Laukahi P.S. Case No.76 of 2019 instituted for the offence under Section(s) 379, 420, 411/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner has no criminal antecedents. There is no allegation in the written report that petitioner had withdrawn money from the ATM Card of the informant.

In the written report, it is alleged that Informant was trying to withdraw money from ATM, but he could not succeed. Then, the petitioner offered to help. The petitioner after taking the ATM card of the informant started running away along with another accused. Later on, he was apprehended by the

Patna High Court CR. MISC. No.40498 of 2019(3) dt.03-09-2019 2/2 informant. From his possession, ATM Card of the informant and several other ATM Cards, as mentioned, in the seizure list have been recovered.

Learned APP submits that several ATM Cards have been recovered from possession of the petitioner. Counsel for the petitioner submits that there is no allegation that petitioner has withdrawn money from ATM Card of the informant.

Petitioner is in custody since 19.04.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Jhanjharpur, in connection with Laukahi P.S. Case No.76 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
