Petitioner, who is in custody, seeks bail in connection with Special (N.D.P.S.) Case No. 50 of 2018 arising out of Digha P.S. Case No. 271 of 2018 registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act. Informant who is the police officer has state that on secret information he along with other police personnel reached the said place and apprehended the petitioner while he was trying to flee away and thereafter recovered 5 kilogram Ganja, which was kept in the jute bag from the handle of the red and white color scooty.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offecne. He has been
Patna High Court Cr.Misc. No.53224 of 2018(3) dt.25-10-2018 2/2 falsely implicated in this case due to highhandedness of police. Nothing has been recovered form the possession of petitioner. He has no concern with alleged recovery. He is not the owner of the said vehicle. He has no criminal antecedent. He is in custody since 25.05.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna in connection with Special (N.D.P.S.) Case No. 50 of 2018 arising out of Digha P.S. Case No. 271 of 2018.
