The petitioner seeks bail in S.Tr.No.418 of 2017 arising out of Janki Nagar P.S.Case No.118 of 2017 registered for the offences under Section 302/34 of the I.P.C. and Section 27 of the Arms Act.

Allegation against the petitioner is of firing on the brother of the informant causing his death.

Submission on behalf of the petitioner is that in this case inquest report was prepared on 10.06.2017 at 19.40 P.M., dead body was received on 11.06.2017 at 9.30 A.M. which was held at 10.45 and the case was registered on 11.06.2017 at 14.30 P.M. which creates doubt about the prosecution case and the parentage of the petitioner has not been given in the F.I.R.

Patna High Court Cr.Misc. No.53188 of 2018 (3) dt.05-10-2018 2/2 Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, as stated above, I am not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected.

However, let the trial be expedited.

This application is dismissed.
