The petitioner in the present case is seeking anticipatory bail in connection with Bettiah Town P.S. Case No. 663 of 2018 registered for the offence punishable under Section 387 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is one of the Directors of one private limited company, namely, Pushpanjali City Homes Private Limited which deals in real estate business. It is his stand that the informant had received sum of Rs. 5 lakhs from the company with a promise to execute the sale deed of a piece of a land but because the sale deed was not being executed when the petitioner tried to pursue the matter with the informant, the

Patna High Court CR. MISC. No.39078 of 2019(3) dt.20-09-2019 2/3 present case has been lodged against the petitioner. It is submitted that this petitioner has lodged a complaint case in this regard.

Learned counsel for the Sate has upon perusal of the case diary submitted before this Court that the allegation against the petitioner is that he had given a phone call to the brother of the informant and had threatened him of dire consequences if the sale deed is not executed. Save and except this allegation, learned APP submits that so far the investigating officer has not collected other materials in the case diary.

Considering the facts and circumstances of the case where there seems to be a dispute over execution of a sale deed with respect to a piece of land and the only allegation which has surfaced till now is that the petitioner had given a telephone call to the brother of the informant and no other material has been collected so far, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Bettiah Town P.S. Case No. 663 of 2018 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, subject to the conditions as laid down under

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
