JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Sikandra P.S. Case No.43 of 2016 registered under Sections 420, 406, 409, 467, 468, 469 and 471/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the name of the petitioner has been given in the FIR only due to suspicion. There is no material to support the allegation that the petitioner is in any way involved in appointment of the elder sister of the informant.

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. Be that as it may, regard being had to the nature of

No.28951 of 2016 (3) dt.26-07-2016 2/2 offence and the allegation made in the FIR, in the event of arrest or surrender in the court below within six weeks from today, the petitioner, namely, Shyam Sunder Mahto @ Shyam Sundar Prasad, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jamui in connection with Sikandra P.S.Case No. 43 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
