The petitioner has preferred this application for grant of regular bail in a case registered under sections 498A, 364 and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant who was married to Md. Kismat was killed by the accused persons including the petitioner herein and her body was disposed of.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There are no eye-witness to the occurrence. The allegations are general and omnibus in nature. The petitioner happens to be the younger

Patna High Court CR. MISC. No.52540 of 2021(4) dt.04-04-2022 2/2 brother of the husband of the deceased. The husband of the deceased has been enlarged on bail vide order dated 21.12.2020 passed in Cr. Misc. no. 20660 of 2020. The petitioner is in custody since 25.2.2021 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to the husband of the deceased together with the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Laukaha P.S. Case no. 128 of 2016 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Jhanjharpur, District Madhubani.
