Petitioner prays for bail in connection with Mozahidpur (Babarganj) P.S.Case No. 03 of 2018, corresponding to S.T.No. 382 of 2018, registered for the offences punishable under Sections 364, 379 and 307/34 of the Indian Penal Code.
Allegation as per FIR is that one Gaurav Goswami @ Baba has kidnapped the informant and kept her in the campus of rolling mill where other accused persons, including the petitioner were waiting and further allegation against one Kundan Yadav is of assault to the informant by knife. Submission of learned counsel for the petitioner is that the allegation of kidnapping and assault is against other accused persons and there is no specific overt act alleged against
Patna High Court Cr.Misc. No.55102 of 2018(3) dt.31-10-2018 2/2 the petitioner and he is in custody since 7.3.2018. Further submission is that similarly situated co-accused has been granted bail by the then co-ordinate Bench of this Court vide order dated 16.7.2018 passed in Cr.Misc.No. 42332 of 2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge, Bhagalpur, in connection with Sessions Trial No. 382 of 2018, arising out of Mozahidpur (Babarganj) P.S.Case No. 03 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
