2. This petition has been preferred by the petitioner being aggrieved with the order dated 13.02.2024 whereby the learned Additional Sessions Judge - III, Barh has rejected the application submitted by the petitioner under Section 311 of Cr.P.C.

3. When the matter is taken today no one is appearing on behalf of the petitioner. It is submitted by the learned counsel for the respondent-State that since, this petition has been preferred against the order whereby the application submitted under Section 311 of Cr.P.C. has been rejected and no criminal writ is maintainable.

3. Considering the above made submission by the
