The petitioner seeks bail in connection with Maheshkhut P.S. Case No. 65 of 2017(G.R. No. 1488/2017) dated 24.05.2017 instituted for the offences under Sections 304B, 328, 34 of the Indian Penal Code.
The petitioner is husband of the deceased.
Though there is allegation in the F.I.R of ill treatment and killing of the deceased but the postmortem report reveals otherwise. No external or internal injury was found on the person of the deceased. The viscera report was sent for forensic examination and the forensic report further discloses that no metallic, alkaloidal, glycosidal, pesticidal or volatile poison was detected. Patna High Court Cr.Misc. No.45689 of 2017 (7) dt.03-01-2018 2/2 submitted that petitioner is a poor person and had, to the best of his ability, afforded treatment to his wife who was suffering from epilepsy. The petitioner is in custody since 07.06.2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Maheshkhut P.S.
