JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-04-2022 Heard Mr. Umesh Kumar, learned counsel for the petitioner and Mr. Mukeshwar Dayal, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Hulasganj PS Case No. 83/2021 registered for the offence punishable under Sections 414 of the IPC.

As per FIR, the police intercepted the petitioner and recovered one motorcycle along with three stolen batteries from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has falsely been implicated in this case while he was returning after attending marriage ceremony from his sister's matrimonial home. He further submits that the petitioner is in custody since 20.06.2021

Patna High Court CR. MISC. No.51589 of 2021(2) dt.15-04-2022 2/2 and this is the first offence of the petitioner. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner has got no criminal antecedent, he is in custody since 20.06.2021, charge-sheet has been submitted in the matter and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, RAMASHANKAR KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Jehanabad/the court concerned in connection with Hulasganj PS Case No. 83/2021.
