JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Muffasil P.S. Case No.244 of 2017, registered for offences alleged under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that, in the present case, the petitioner has falsely been implicated merely on suspicion. There is no recovery from the possession of this petitioner and, in fact, he was named in Muffasil P.S. Case No.249 of 2017 registered under Section 414 of the Indian Penal Code and under the provisions of the Arms Act in which he has been granted

Patna High Court Cr.Misc. No.44587 of 2017 (2) dt.20-09-2017 regular bail by a coordinate Bench of this Court in Cr.Misc.No.39446 of 2017.

On the other hand, learned APP for the State opposed the prayer for bail.

However, considering the order granting bail to the petitioner by a coordinate Bench of this Court, let the petitioner, namely, Md. Sakil be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-5th, Samastipur in connection with Muffasil P.S. Case No.244 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
