Petitioner seeks bail in Bhagwanpur Hat P.S. Case No.148 of 2017 instituted for the offence under Section(s) 304B/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, II, Siwan.
Petitioner is husband of the deceased.
As per allegation in the written report, deceased was married with this petitioner on 19.04.2017. After marriage, she went to her matrimonial house and resided happily for few days. She was brought from her Naihar to Sasural by the accused persons on 26.06.2017. Thereafter, she was taken to Sadar Hospital, Siwan, where the doctor has declared her dead.
Patna High Court Cr.Misc. No.53059 of 2018 (3) dt.27-09-2018 2/2 Counsel for the petitioner submits that a petition has been filed in the Court below that this petitioner and other accused had not tortured the grand-daughter of the informant. As per allegation in the written report, deceased was done to death within two months of her marriage and her death was unnatural.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected. Liberty is given to the petitioner to renew his prayer for bail after six months if no substantial progress is made in the trial.
