2 The petitioner apprehends his arrest in connection with Fatehpur PS Case No 426 of 2022 instituted under Sections 341, 323, 325, 307, 379 and 506/34 of the Indian Penal Code. 3 As per the prosecution case, the allegation against the petitioner is that he assaulted with iron rod at the head, nose and leg of the husband of the informant and co-accused Bikram Singh assaulted with the butt of the kudal causing fracture on the leg of the husband of the informant.

4 Learned counsel for the petitioner submits that after investigation, police submitted charge sheet against co-accused Bikram Singh and Karu Singh. However, there was no material

No.43006 of 2023(2) dt.04-08-2023 2/2 found against the petitioner and the final form was submitted before the Court concerned but the Court concerned has taken cognizance against the petitioner also. He has further submitted that petitioner has no criminal antecedent and he has been falsely implicated in this case due to land dispute. It is also submitted that there is no material in the case diary against the petitioner.

5 Learned APP opposes the prayer for anticipatory bail.

6 Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Fatehpur PS Case No 426 of 2022, subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
