JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Magadh University P.S.Case No.46 of 2015 registered under Sections 420, 467, 468, 471, 474, 477A, 120B and 201/34 of the Indian Penal Code.

It is contended that the petitioner has no concern with co-accsued Parampal Singh Gandhi. The petitioner was a professor in a college at Gaya and was for the first time deputed in Examination Department of the University on 29.7.1997 as a Joint Controller where he remained merely for eight months whereas Parampal Singh Gandhi was enrolled in the Session 1987-89. The examination for the sessions 1987-89 took place in the year 1991 and Parampal Singh Gandhi was declared pass in the year 1993 and his degree was also issued much before his joining as Joint

The petitioner has nothing to do with the affairs which took place before joining on the post. By now the petitioner has retired from service and is aged about 72 years. It has further been pointed out that the main accused Parampal Singh Gandhi has already been granted anticipatory bail by a Bench of this Court vide order dated 13.10.2015 passed in Cr. Misc. No.47756 of 2015 and the case of the petitioner stands on better footing than him. Learned counsel for the State has opposed the application filed on behalf of the petitioner.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjiv Kumar Rai, A.C.J.M.-IX, Gaya, in connection with Magadh University P.S. Case No.46 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
