JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Rakesh Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 04-07-2017 in Sasaram (Muffasil) P.S. Case No. 932 of 2017 registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 on an allegation of recovery of about 95 liter of country-made liquor, has prayed for grant of bail.
Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner, rather recovery was shown beneath the tree of Mahua and petitioner has falsely been implicated.
Considering the nature of accusation and period of custody, let the petitioner namely Dilip Kumar Singh be
Patna High Court Cr.Misc. No.41884 of 2017(2) dt.19-09-2017 2/2 enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 932 of 2017.
