Learned counsel for the petitioners submits that petitioner No. 1 (Bhola Sah) has been taken into custody and, therefore, the application against him has become infructuous. It is, accordingly, dismissed as having become infructuous. So far as petitioner No. 2 (Govind Sah) and petitioner No. 3 (Lakhinder Sah) are concerned, they apprehend their arrest in connection with a case registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code. Considering the nature of allegations made against them and that they are cousins of petitioner No. 1 and having one antecedent in Kundi P.S. Case No. 319 of 2014 filed by the sister of petitioner
Patna High Court Cr.Misc. No.48322 of 2015 (3) dt.18-01-2016 P2/2 No. 3 and also they have no other criminal antecedent, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 611 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
