The Petitioner seeks revision of the order dated 24.09.2013 passed by the Sessions Judge, Munger in Sessions Case No. 231 of 2011 by which he has rejected an application for exhibit the sale deed.
Since it is in the interest of justice that the Petitioner be permitted to bring all documents in his favour during trial, the order is set aside and the Court is directed to exhibit the documents within a period of three weeks from the date of receipt of this order the validity of which shall be tested at a later stage.
The Application stands allowed.
From henceforth, the Trial Court should be cautious in unnecessarily refusing such prayers and
Patna High Court CR. REV. No.1242 of 2013 dt.06-07-2015 consequently delaying the trial since I find that even though the impugned order was passed on 24.09.2013 i.e. almost two years ago the trial has not concluded as yet. Had he allowed the prayer the trial would have concluded by now.
