ANJANA MISHRA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.7.2017 in connection with Chhatauni P.S. Case No.181 of 2017 registered for the offence under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the F.I.R. is against unknown but subsequently, the petitioner's name has surfaced on the basis of the confessional statement of co-accused Arun Rai, which has been recorded before the police and which has no evidentiary value. He further submits that the petitioner has no concern with the said Deepak Paswan whose name is alleged to have been taken at the time

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, in connection with Chhatauni P.S. Case No.181 of 2017.
