Petitioner seeks bail in Forbesganj P.S. Case No.154 of 2018 instituted for the offence under Section(s) 302, 201, 120-B/34 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Chief Judicial Magistrate, Araria. It is alleged in the written report that father of the informant was working as Constable in Supaul District. He was shot dead while on election duty in Araria district. The informant learnt that during election his father was deputed on duty at Jogbani Police Station. While he was on duty, he was taken to the house of Vijay Marandi of Forbesganj. In the evening, after taking dinner he slept in the house of Vijay Marandi. In the morning at 7-8 AM, this petitioner shot dead his father and his

He also learnt that Vijay Marandi, Manoj Kisku, Marangamay Devi and other family members were present along with the petitioner. They were attempting to hide the dead body towards west of house. They had kept rifle and cartridges of his father in the wheat field towards south of the house. It is also alleged that this petitioner fled away with rifle and cartridges.
Case diary has been received.
Learned APP has submitted that during investigation police recorded confessional statement of Vijay Marandi in para 24 of the case. Vijay Marandi in his confessional statement has stated that this petitioner had shot dead father of the informant. The police after investigation has submitted charge-sheet finding the case true.
In view of such, there is specific allegation against this petitioner.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected at this stage.
