Petitioners seek bail in connection with Shahpur P.S. Case No. 130 of 2017 for offences punishable under Sections 363, 365, 34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while his daughter Sunita Devi was near the house on the road with 1 1⁄2 year old son, four persons came in Scorpio and took away 1 1⁄2 year old son of his daughter. On Hulla the villagers chased the vehicle and caught the petitioners along with another

Patna High Court Cr.Misc. No.48023 of 2017 (3) dt.23-11-2017 2/2 and recovered the child.

It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history and no such occurrence had taken place and that the matter has already been compromised. He submits that charge-sheet has already been submitted and the petitioners are languishing in judicial custody since 12.06.2017.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-14, Bhojpur at Ara in connection with Shahpur P.S. Case No. 130 of 2017, subject to the condition that both bailors would be close relative of the petitioners having sufficient immovable property, who will file an affidavit stating their relationship with the petitioners.
