The petitioner seeks bail in Kochas ( Parasthua) P. S. Case No. 136 of 2018 instituted for the offence under Section(s) 399, 402, 411, 414 of the IPC and Section 25(1-b)a, 26, 35 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is not named in the written report. His name has come in the confessional statement of co-accused Manjeet Kumar who has been arrested by the police. The aforesaid Manjeet Kumar had stated in his statement before the police that he had sold the same silver to this petitioner.
Learned counsel for the petitioner submits that petitioner has a jewellery shop and aforesaid recovery has been made from the said shop. There is no mention in the written
Patna High Court Cr.Misc. No.53283 of 2018(3) dt.05-10-2018 2/2 report of any case in which the aforesaid silver was stolen which was sold to the shop of the petitioner. Petitioner is in custody since 20.07.2018. Petitioner has no criminal antecedent. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-I, Rohtas at Sasaram, in connection with Kochas ( Parasthua) P. S. Case No. 136 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
