The petitioner seeks bail in Pirpainty P.S. Case No. 320/2017, instituted for offences under Section(s) 302, 201/34 of the Indian Penal Code.
It is alleged in the written report that on 06.11.2017 at about 6 O'clock in the evening, the petitioner along with other accused persons took the son of informant with them, but he did not return. It is alleged that on 09.11.2017 informant learnt that a dead body is lying in Bakharpur 28th Bahiyar in decomposed condition. The informant reached there and identified the dead body of his son. The informant raised suspicion against this petitioner and other accused persons.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.39900 of 2019(2) dt.03-07-2019 2/2 besides last seen, there is no allegation against this petitioner. The other co-accused has already been granted bail by a Co-ordinate Bench of this Court vide order dated 06.05.2019 passed in Cr. Misc. No. 11311/2019.
Petitioner is in custody since 25.01.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge XIth, Bhagalpur, in connection with Pirpainty P.S. Case No. 320/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
