Petitioner seeks bail in a case registered for the offence punishable under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he along with others is said to have killed husband of the informant because of old enmity.
Earlier bail application of the petitioner was rejected vide Annexure-1 to the present application. This is the second attempt for grant of regular bail on behalf of the petitioner. A report was called for from the trial court regarding stage of the case. It has been reported that out of eleven witnesses, five witnesses have already been examined and the trial is expected to be concluded within a period of three months. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. The trial court, i.e., learned Addl. District and Sessions Judge-IV, Barh, Patna, is directed to conclude the trial in connection with S.
