JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Khaira P.S. Case No. 66 of 2003 registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code, 27 of the Arms Act, 3⁄4 of Explosive Substance Act and 17 of C.L.A. Act.
It is obvious that petitioner approached the court for grant of anticipatory bail after more than eight years of institution of the case.
Therefore, considering the aforesaid fact, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Khaira P.S. Case No. 66 of 2003 pending in the court of Chief
Patna High Court Cr.Misc. No.13135 of 2013 (6) dt.24-03-2015 Judicial Magistrate, Jamui stands rejected.
However, if petitioner surrenders before the concerned court within four weeks from today and seeks regular bail, the prayer for regular bail of the petitioner shall be considered on its own merit without being prejudiced by this rejection order.
