The petitioner seeks bail in Bachhwara P.S. Case No. 40 of 2021, registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner is alleged to have played the role of liner.

It is submitted on behalf of the petitioner that petitioner is not the assailant of deceased. Specific allegation of assault upon the deceased is against other co-accused. Petitioner has been falsely implicated in this case due to previous enmity between the petitioner and informant. Petitioner claims clean antecedent and he is in custody since 12.02.2021.

Patna High Court CR. MISC. No.52373 of 2021(2) dt.02-12-2021 2/2 Counsel for the Informant vehemently opposed the prayer for bail and submitted that this petitioner is instrumental in murder of the son of informant.

Considering the facts and circumstances of the case and the fact that petitioner is alleged to be the liner only having clean antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S.
