The petitioner seeks regular bail in Kathaiya P.S. Case No.70 of 2017 registered for the offence under Section 272, 273 of the I.P.C. and sections 30A, 53(C) of the Bihar Prohibition Excise Act.

Allegation against the petitioner is of recovery of 3 1⁄2 liters liquor from the petitioner and he is accused in two other cases.

Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner. Recovery is not from the

Patna High Court Cr.Misc. No.41511 of 2017 (2) dt.07-09-2017 2/2 house of the petitioner rather from the bush of the lemon tree. The petitioner is accused in two more cases of similar nature though both cases have been lodged one after another at the instance of the police. He is in custody for one month.

Heard learned A.P.P. also.

Having heard both sides and in view of the criminal antecedent, this application is disposed of with direction to the court below to release the petitioner on bail to his own4 satisfaction either once charge is framed against this petitioner or on completion of three months of the petitioner in custody.
